Purpose

This Agreement establishes the terms and conditions under which the Receiving Organization will accept and distribute donated gift-in-kind items provided by the Next Generation Empowerment Center for the benefit of individuals and families within the community.

The intent of this partnership is to ensure donated items are distributed ethically, responsibly, and in accordance with the donor's charitable purpose.

Gift-in-Kind Items

The donated items may include, but are not limited to:

  • Clothing

  • Household goods

  • Hygiene products

  • School supplies

  • Toys

  • Food (when applicable)

  • Baby items

  • Personal care items

  • Holiday gifts

  • Emergency supplies

  • Other donated merchandise

Receiving Organization Responsibilities

The Receiving Organization agrees to:

1. No Sale of Donated Items

Gift-in-kind donations shall NOT be sold for profit under any circumstances.

2. No Raffles or Auctions

Gift-in-kind items shall NOT be:

  • Raffled

  • Auctioned

  • Used as contest prizes

  • Exchanged for donations

  • Used as fundraising incentives

unless prior written approval is obtained from the Next Generation Empowerment Center.

3. Community Distribution Only

All donated items shall be distributed free of charge to eligible community members who demonstrate need.

4. Event Notification

The Receiving Organization agrees to provide the Next Generation Empowerment Center with the following information before distribution:

  • Event Name

  • Event Date

  • Event Time

  • Event Location

  • Estimated Number of Participants

Notification should be submitted no later than 10 business days prior to the event whenever possible.

5. Inventory Tracking

The Receiving Organization shall maintain a complete inventory of all donated items received.

The inventory shall include:

  • Item description

  • Quantity received

  • Quantity distributed

  • Quantity remaining (if applicable)

6. Inventory Report

Within five (5) business days following the community giveaway, the Receiving Organization shall submit:

  • Complete inventory report

  • Distribution summary

  • Remaining inventory (if any)

7. QR Code Tracking

The Receiving Organization agrees to utilize the official QR Code supplied by the Next Generation Empowerment Center.

Each recipient receiving donated items shall complete the QR Code registration prior to receiving their gift whenever feasible.

The QR Code data will assist in documenting:

  • Recipient participation

  • Number of individuals served

  • Community impact

  • Grant reporting

  • Donor accountability

8. Event Documentation

The Receiving Organization agrees to provide within five (5) business days:

  • Event attendance totals

  • Photographs (when permitted)

  • Distribution summary

  • Success stories or testimonials (optional)

  • Media links (if available)

9. Record Retention

All records related to donated items shall be maintained for a minimum of three (3) years and made available upon reasonable request.

10. Compliance

The Receiving Organization agrees to comply with all applicable federal, state, and local laws regarding charitable distributions and nonprofit operations.

Misuse of Donations

Failure to comply with this Agreement may result in:

  • Immediate suspension of future donations

  • Termination of the partnership

  • Requirement to return remaining donated items

  • Ineligibility for future gift-in-kind opportunities

Term

This Agreement becomes effective upon signature and shall remain in effect until terminated by either party with written notice.

Hold Harmless

Each party agrees to hold harmless the other from claims arising from its own negligence or misconduct in connection with the handling or distribution of donated items.

Entire Agreement

This document represents the entire agreement between the parties concerning the receipt and distribution of gift-in-kind donations and may only be amended in writing signed by both parties.
